How many lawyers can boast that they had the largest reported settlement or verdict in their state in a given year?  Not many.  But we can.  In 2010, Gary August had the largest settlement or verdict in the entire State of Michigan, as reported to Michigan Lawyers Weekly, arising from his representation of the City of Dearborn against one of the State’s largest construction contractors, its insurance company, and its architect and engineers.  No other firm or lawyer reported a litigation outcome greater than Mr. August’s, and this is just one example.  Taking Mr. August’s work for the City of Dearborn on its combined sewer overflow litigation alone, in a total of seventeen litigated cases, he defeated over $41 million in claims against Dearborn while at the same time recovering over $30 million – thus an over $70 million benefit to Dearborn.  And this is just the beginning.  Mr. August won, not settled, a class action against Dearborn related to sewer and water rates where the exposure to the City was over $60 million.

Mr. August’s longstanding work for Dearborn is just one example of his clients’ victories on high-dollar, high-consequence litigation.  Keeping the focus on only the largest cases, Mr. August was retained to defend a General Electric joint venture pipeline inspection company with respect to its allegedly failed role in inspecting the Enbridge pipeline that burst in Marshall, Michigan, causing the largest inland oil spill in the entire history of the United States – over $1 billion.  Mr. August’s client was sued by landowners, claiming damages to property and businesses due to the rupture.  Mr. August obtained full dismissals of all claims against his client based on multiple legal arguments.

Mr. August also represented Northwest Airlines as its lead litigation attorney with respect to the construction of the McNamara Terminal and related facilities at the Detroit Metropolitan Airport. Originally, the project was over $1.2 billion but grew closer to $1.6 billion with phases II and III. In that time, Mr. August handled over 70 matters for Northwest Airlines on the project, ranging from efforts of one contractor to terminate its over $500 million contract to bringing and defending claims against other contractors, architects, and engineers. In the more than 70 matters handled by Mr. August for Northwest Airlines on this project over a 12-year period, he did not lose a single matter. Ultimately, Mr. August was retained by the Wayne County Airport Authority itself to litigate on its behalf, where he continued his unblemished record on multiple cases, including a full dismissal of a highly publicized American Disabilities Act lawsuit brought by a transportation company that was affirmed in a published 6th Circuit Court of Appeals opinion.

Mr. August’s prowess for winning big dollar lawsuits has not gone unnoticed by the media.  Mr. August was featured in a July 2016 Crain’s Detroit Business Special Report as one the State’s Top 14 “Litigators” recognizing his numerous successes and the importance of the matters litigated.

While lawyers can boast about the matters they litigated, only a select few can boast about winning large dollar and publicized cases on a consistent basis.  August Law wins.

Gary August, our principal attorney, has been litigating for almost thirty years after graduating near the top of his class from Northwestern University School of Law in Chicago in 1993.  After clerking for Richard Kaufman, Chief Judge of the Wayne County Circuit Court, and Helene White (now Judge on the United States Sixth Circuit Court of Appeals), he began his career at Honigman, Miller, Schwartz, and Cohn in Detroit, Michigan, where he learned the foundations for practicing complex litigation.  Mr. August left the Honigman Firm to be a part of a growing litigation firm that ultimately became Zausmer, August & Caldwell.  Mr. August was instrumental in growing this firm from approximately 8 lawyers in 2000 to over 80 when he retired from the firm in 2019.  During this period, he substantively learned the foundation of the law, which allowed him to be consistently recognized as one of the top litigation lawyers in Michigan.

Mr. August has handled so many various problems for such a different array of clients, that he has a fundamental understanding of almost any legal issue that comes through the door.  There are some areas where his expertise is virtually unparalleled in the community, such as construction litigation.  Mr. August is the go-to attorney for owners who have construction projects that go wrong and find themselves in litigation.  Mr. August earned this reputation through his representation of Northwest Airlines on the construction of the McNamara Terminal and related facilities at the Detroit Metropolitan Airport, which at the time was the largest construction project in the State of Michigan.   His representation of the City of Dearborn on its Combined Sewer Overflow Project netted some of the biggest settlements and verdicts in the State of Michigan.  This led to his retention by Wayne County on its failed consolidated jail project, which was the most publicized municipal matter in Detroit at that time.  Mr. August not only successfully pursued litigation against the contractors, architects, and engineers on the project, but he negotiated and drafted the agreements for the construction of the County’s new Criminal Justice Center, including a complicated five-parcel land swap, public bond funding of $300 million, parking concessions, leasebacks, and specifications for the new Criminal Justice Center that was being built by the purchaser of the County’s property.  This was by far the most complicated municipal deal in the State of Michigan at that time.
