We fully understand the Home Rule Cities Act, the Open Meetings Act, the Freedom of Information Act, the Headlee Amendment, and many more. Gary August’s representation of municipalities dates back decades. He has litigated many matters for municipalities regarding the requirements and restrictions of the Headlee Amendment.
He represented Wayne County in multiple Headlee challenges against the State of Michigan regarding unfunded mandates. He also successfully defeated an over $60 million class action claim against the City of Dearborn under the Headlee Amendment regarding its rate model for setting sewer and water rates.
He defended his victory in the Michigan Court of Appeals, and the case is currently pending before the Michigan Supreme Court. He also represented the Great Lakes Water Authority in a class action with respect to stormwater charges. Mr. August’s representation of municipalities extends beyond litigation. He has negotiated countless interlocal agreements and other contracts for municipalities, including renegotiating Lyon Township’s wastewater infrastructure contract, resulting in millions of dollars in savings for residents and businesses in the Township.
